ThePack Loyalty & Rewards Program 1.0 | Terms & Conditions
1.1 Welcome to ThePack Loyalty & Reward program of Dragon Label Limited Hong Kong (“ThePack”), with incorporation number 2594552 and registered seat at Unit 1603, 16th Floor, The L. Plaza, 367-375 Queen’s Road Central, Sheung Wan, Hong Kong, PRC ("Loyalty Program"). By becoming a member you agree to be bound by these Terms and Conditions.
1.2 The membership is free of charge and no purchase is necessary to become a member.
1.3 By becoming a member of ThePack Loyalty & Reward Program, you will be eligible to take part of exclusive offers, services, events and much more organized by ThePack or ThePack partner companies. You will also earn points, which correlate to different membership tiers and reward incentives. When you log in as a member, we will give you a tailormade experience, including personalized offers and recommendations. As a member, you will also receive digital receipts for all online and in-store purchases, which you may access in your store membership account ("My Account") on thepackunderwear.com. When adding items to your shopping cart, we will save all items between your logged in visits. Please note that items stored in the shopping cart will not be reserved for you and may sell out.
1.4 You can find information regarding how ThePack will process your personal data in the Privacy Notice.
2.1 The membership is limited to individuals that are acting in a personal capacity and not in the capacity of a company, who have a current and valid email account and are considered an adult by local legislation in the applicable province or territory of residence, or from 16 years of age who have the consent of the parent(s), guardian or legal representative as applicable. ThePack reserves the right to request written confirmation of such consent. Wholesale and/or Dropship customers or individuals will not be recognized for membership as items sold for any commercial or bulk purchases is transacted at a heavily discounted price. Employees, officers, directors, agents and representatives of ThePack are eligible for membership but may be excluded from certain promotions.
2.2 By submitting your application, you confirm that you are of at least the age to be considered an adult by local legislation in your province or territory of residence, or 16 years of age and have the consent of your parent(s), guardian or legal representative as applicable, and that you agree to these Terms and Conditions.
2.3 Your membership is personal, non-transferable and subject to these Terms and Conditions as well as any other rules, regulations, policies, and procedures adopted by ThePack as approved by you upon taking part of offers, rewards, making purchases and other related services. We apply a limit of one membership per person and registered email address.
2.4 Companies, groups, associations or other entities, or others making commercial or bulk purchases including wholesale and/or dropship arrangements are not eligible for membership. The membership may not be used for reselling or profit.
2.5 It is your responsibility, and a condition for your membership, to keep your email address and contact details up to date.
2.6 You are responsible for all activity that is conducted through your membership account. This means you are responsible for making every effort to keep your email address and password secure and private. We advise using a unique password that has not been used on any other account. If your password or account is compromised, we advise you change it quickly or reach out to firstname.lastname@example.org.
3 THEPACK LOYALTY & REWARD PROGRAM
3.1 The membership is a worldwide program and limited to purchases made online at thepackunderwear.com only. You can only earn points by shopping as a logged in member or by performing other point awarding activities as communicated from time to time by ThePack. Please note that you will not earn points on purchases of gift cards.
3.2 The points earned are personal and cannot be transferred to another person or member.
3.3 To receive points you must sign into My Account – ThePack Underwear before making your purchase. You may view your balance at any time by visiting My Account.
4 POINTS, TIERS AND VOUCHERS/DISCOUNT CODES
4.1 The points you earn count toward the second-tier membership as well as vouchers/discount codes.
4.2 The date when you become a member will constitute the commencement of each Membership Year (“Start Date”). The “Membership Year” is the 12 months following the Start Date of each year. The tier level of your membership is based on the points earned during the current or previous Membership Year whichever is the highest. If you are a new member, or do not have sufficient points to qualify you to the second-tier membership level, your membership tier level will start at the first-tier. If you reach the second-tier during a Membership Year you will stay at the second-tier membership level during the rest of the Membership Year and the following Membership Year. If you during the Membership Year do not accumulate sufficient points to qualify you to the second-tier membership level, you will return to the first-tier for the following Membership Year.
4.3 After the end of each Membership Year all points counting towards the next membership tier level will be reset and start over at (0) zero at the beginning of each Membership Year.
4.4 The points counting towards the voucher/discounts are valid until the next Start Date.
4.5 When you have earned one-hundred (100) points, you can start redeeming USD$1 by issuing a voucher/discount code under the tab marked “ways to redeem” to be applied at the checkout page. Only one (1) voucher/discount code will be redeemed per time. More than one (1) voucher/discount code is not allowed.
4.6 Vouchers/discount codes cannot be exchanged for cash, gift cards or used for purchases that totals an amount less than the value of the bonus voucher. The sum total of the purchase, after the voucher/discount code is applied, must exceed USD$1.
4.7 Each voucher/discount code is only redeemable once and is applied on all articles in the order. The discount is split between the articles so that the discount share per article remains the same for all articles in the order. The respective reduction of the individual articles of a purchase remains.
4.8 In the case of a refund, the discount advantage received through the bonus voucher (value of the voucher/discount code) expires. Only the amount paid for the article will be refunded, not the savings from the voucher/discount code.
4.9 The vouchers/discount codes cannot be used to purchase Gift Cards, or be applied to past purchases.
5 CHANGES, TERMINATION AND/OR REMOVAL FROM THEPACK LOYALTY & REWARD PROGRAM
5.1 You may cancel your membership at any time through My Account – ThePack Underwear or by contacting email@example.com. Please note that cancelling your membership means that you will only be able to shop with us using the guest checkout.
5.2 If you cancel your membership any points which remain in My Account will be forfeited.
5.3 ThePack may, at its sole discretion, terminate, alter, limit, suspend or modify the Loyalty & Reward Program, and/or the Terms and Conditions at any time, in case of changes to applicable laws, changes in services provided by ThePack or introducing new services. Any such change will take effect after 14 days from the date on which you have been informed of such change either in My Account, on thepackunderwear.com, via mail or a combination thereof. If you do not accept the changes you have the right to cancel your membership.
5.4 ThePack reserves the right to make minor changes to the Loyalty & Reward Program and its Terms and Conditions without providing you with prior notification, provided that these changes do not materially affect the membership in a negative way. Please make sure to stay updated on the Terms and Conditions. You will always find the latest version of the Terms and Conditions on thepackunderwear.com.
5.5 Any proven abuse of the Loyalty & Reward Program, proven or reasonably assumed fraud, failure to follow the Terms and Conditions, membership inactivity, any misrepresentation or any conduct detrimental to the interests of ThePack may subject you to membership revocation and will affect eligibility for further participation in the Loyalty Program. If your membership is revoked, any points in My Account will automatically expire.
5.6 We reserve the right to restrict your access to browse and shop via your membership on thepackunderwear.com at any time without notice and at our sole discretion for any reason. Reasons for restriction may include, but are not limited to the following: (1) Frequent and/or high rates of returns deemed unusual; (2) Behavior(s) demonstrating the intention to resell and/or make a profit through the purchasing of our products; or (3) Suspected multiple accounts and/or the registration of a new account by a previously suspended user. We also reserve the right to cancel orders placed via your membership account for the same reasons, and to cancel orders placed in guest checkout with the same billing address, shipping address or method of payment. 6 LIMITATIONS OF LIABILITY
6.1 ThePack will not be liable for any system failure or malfunction of the Loyalty & Reward Program or any consequences thereof. ThePack accepts no liability for any loss or damages arising from suspension, variation or termination or in any other way relating to the Loyalty & Reward Program, except for any liability which cannot be excluded by law.
7 APPLICABLE LAW AND JURISDICTION
7.1 These Terms and Conditions shall be governed by the laws of Hong Kong, without regards to any rules or principles on conflicts of laws. However, if you are resident in another country than Hong Kong these Terms and Conditions can be subject to mandatory consumer protection laws and regulations in force in the country of residence which may provide you with additional rights. Any dispute, claim or controversy arising from or relating to these Terms and Conditions or your membership shall be resolved by the applicable courts in Hong Kong, unless otherwise stipulated in applicable mandatory laws of your country of residence.
7.2 The invalidity or unenforceability of individual contractual provisions shall not affect the validity of the remaining contractual provisions. In such case, the ineffective or unenforceable provision shall be replaced by the parties by an effective or practicable new provision.
